The families of Debra Carder and James Richard Nation are seeking the order against James Leon Williams, the truck driver, Allon Transportation Services, Inc., his employer, and Wreck Truck Repair and Used Truck Sales. According to the plaintiff's attorneys, the truck was towed and possibly sold to the wrecking yard after the trucking company had been advised of the need to preserve evidence for pending lawsuits against the driver and his employer.

The lawsuit states that the condition of the truck may be an issue in the case, and that the plaintiffs' rights would be violated by any further damage to the truck

According to the accident report, the truck rear-ended Nation's car and pushed it into Carder's car. The report says the truck then hit a bread van, which then hit Carder's car. Nation's car burst into flames, according to the report, the bread truck rolled over onto another car, and the truck driven by Williams struck two more cars before coming to rest.
