Toxic Mold Case Recovers $925,000 Settlement

The court found that the plaintiff in the case had developed a serious, permanent case of asthma as a result of exposure to toxic mold in her apartment building. The mold infestation was caused by a poorly-performed repair following an incident where a toilet on the floor about the plaintiff's apartment flooded.

After a seven-day trial, the jury determined that the management of the Maple Creek apartments in Woodhaven, MI, was negligent, after failing to respond to numerous complaints of leaking water and persistent deposits of mold.

The plaintiff had a number of severe asthma attacks, including one during which she stopped breathing. The jury found that her life has been seriously altered as a result of the negligence of the building's management.

Industry guidelines regarding the protocol for cleaning up water and mold damage were widely available from a variety of sources, including the internet, but the building management failed to seek them out.
