Wrongful death trial delayed in railroad accident case

The lawsuit alleges that the railroad and city were negligent in maintaining a railroad crossing where 46-year-old Cynthia Zaehringer was killed in April 2003.

The lawsuit was filed by Zaehringer's daughter Amy, and also names three bars that the plaintiff claims served alcohol to the victim despite her obvious impairment.

A motion to dismiss the suit was filed by the city and railroad, saying Zaehringer failed to respond to the oncoming train and that the train's crew was unable to avoid the crash.

The new date set for the trial is February 27, 2006.
