The suit claims that Holleb was negligent in operating his boat at excessive speeds on Beaver Lake causing Holleb to be ejected and run over. Holleb was struck by the boat's propeller and his left arm was almost severed. He suffered extensive injuries. Holleb contends that he was thrown from the boat when it struck a submerged obstruction.

The boatmaker contends that Priest was negligent in giving full control of the boat to someone with insufficient experience.
