Family of construction worker seeks compensation

74-year-old Herman Calloway of Chicago died June 6 when the trench he was working in collapsed. A trench box, which might have prevented the accident, sat unused nearby at the time of the accident.

The suit was filed by Hattie Franklin, the administrator of Herman Calloway's estate. It names Bovis Lend Lease Inc., the main contractor on the project, and seeks unspecified damages.

Calloway's son, Herman Calloway Jr., was also buried in the accident, but workers were able to rescue him.
