The defendant's vehicle was going a reported 30 miles per hour through the stop sign when it collided with the plaintiffs. The driver in the hit vehicle was knocked unconscious, and suffered a broken pelvis, a punctured lung, as well as head and neck injuries, while his passenger in the vehicle sustained multiple fractures in his facial bones and blows to the head causing him to suffer from seizures, sensitivity to sound, and partial loss of hearing.
The driver who ran the stop sign claimed he could not see the stop sign because it was hidden behind a tree branch, causing the prosecution to name the town of Montclair as a defendant in the case. The branch was subsequently removed, but the town was never found in any way responsible for the crash. Individually, the injured driver was awarded $100,000, while his passenger received $197,500 in compensation for the crash.
