Product Liability Verdict Upheld

The plaintiff, Rachel Warnke, was shaving her leg with the Schick Personal Touch razor when the plastic casing holding the blades broke, causing a deep cut that required 27 stitches.

Warnke was awarded $40,000 in damages in the lawsuit, which claimed defective design.

On appeal, the defendant, Warner-Lambert Co., claimed that there was not sufficient proof provided to support the verdict, and that the judge erred by allowing evidence of prior consumer complaints about the product.

The appellate court unanimously ruled in favor of upholding the original judgment.

Actually, the original judgement was for $120,000 with a jury . The amount awarded was reduced in the appeal. Feel free to ask me any questions....
