Guillermo Toledo, 27, was driving his Ford pickup when the accident occurred. Police officers arrived to find the vehicle on its side, with Juan Rodriguez stuck beneath.

Rodriguez died at the scene.

Toledo was taken to the hospital where a blood test revealed his blood-alcohol level was more than three times the legal limit.

Toledo also had two previous DUI convictions, for which he underwent counseling and treatment.

Toledo will be eligible for parole in 10 years with good behavior.
