Germán Gómez names the Broward Sheriff's Office, Broward County, former deputy Lewis Perry and Sheriff Ken Jenne.

On Nov. 3, after only a few days on US soil, Gómez, a day laborer, was returning to his cousin's apartment when he accidentally went to the wrong door and tried to open it.

A neighbor mistook him for a burglar and called 911.

Gómez and his cousin, Javier Dominguez were walking across the parking lot of the complex when officers arrived. The officers didn't speak Spanish and the men didn't speak English.

Deputy Lewis Perry told investigators that his gun accidentally discharged while attempting to restrain Gómez.

Perry was fired in December after an investigation into an unrelated matter.

Gómez had brain surgery to insert a metal plate in his head in May.
