Student Suing Police Over Head Injury Arrested Again

Diego Jaramillo, 22, filed a $6 million federal lawsuit earlier this year against the Albany Police Department after sustaining a head injury, deviated septum, ruptured eardrum, and several fractures while being arrested. Jaramillo claims that in 2004 officers brutally attacked and beat him without just cause. However, officers claim that Jaramillos' injuries were the result of his fleeing and resisting arrest, not unprovoked police brutality. For his actions leading to his arrest, Jaramillo was charged with felony assault, resisting arrest, and trespassing.
While the personal injury lawsuit still awaits trial, Jaramillo was arrested for assaulting a man at around 3:30 am. The officer who arrived to end the altercation and arrest Jaramillo was elbowed in the head by the student causing them both to fall to the ground. Jaramillo has now been charged with third degree assault for punching and kicking the civilian and felony assault for hitting a police officer. Needless to say, Jaramillo's now repetitive history of resisting arrest and assaulting officers does not help his chances for victory in the civil lawsuit.
