The two allegedly used digital camcorders and remote microphones to record the entertainer's conversation with his attorney as they traveled on a private jet from Las Vegas to Santa Barbara in November of 2003. Jackson was flying with his attorney to Santa Barbara to surrender in a child molestation investigation. Borer allegedly directed Reeves to install the recording equipment on the plane and subsequently contacted several news organizations in an attempt to sell the information. The highly publicized incident was followed by a lawsuit in which Mark Geragos, Jackson's attorney at the time, claimed that the charter company had violated attorney-client privileges.

Neither Mark Geragos nor Jackson's spokesperson, Raymone K. Bain, were available for comment.
