LAPD sued by family of baby killed in shootout

Filed late Monday, the claims accuse police of negligence, and are a precursor to a civil lawsuit.

19-month-old Suzie Marie Pena was killed by a police gunshot as officers engaged her father, Jose Raul Pena, in a shootout on July 10.

During the 2 ½ hour standoff, Pena barricaded himself inside his Watts auto dealership, fired numerous shots at officers and nearby homes and business while using his daughter as a shield, say police.

The girl's family accused police of not giving negotiators enough time to talk the father into surrendering, and reckless use of a flash-bang grenade.
