Mother Files Wrongful Death Lawsuit Against Doctor

Teresa Benz filed the lawsuit against Dr. Harry A. Alexanderian of West Pittston. The lawsuit alleges that Benz's son, Timothy L. Forschner, suffered lower back pain from an auto accident and sought the care of Alexanderian between September 2002 and Novemeber 2003.

According to the lawsuit, Forschner received prescriptions for the drugs Vicodin, Ampicillin, Darvocet, Valium, Motrin, Darvon, Buspar, and Soma Tabs after just a few evaluations from Alexanderian.

Forschner died November 15, 2003 after overdosing on the drugs.

Benz's lawsuit charges Alexanderian with not safely and responsibly treating her son's condition.

It claims that that Alexanderian should have been cautious in prescribing Forschner potentially addictive drugs like Valium and Vicodin given that Forschner had admitted to a record of drug addiction.

It further alleges an MRI revealed that Forschner had not suffered enough damage from his accident to warrant the potent medications he was prescribed.

The lawsuit goes on to claim that Forschner's prescriptions should have been discontinued once he started to display signs of addiction. The lawsuit states that Forschner falsely claimed that his prescriptions had been stolen in order to receive refills before he was scheduled to receive them.
