Vancouver Canucks Seek to Throw Out Lawsuit Filed by Moore

During a hockey game in March of 2004, in an act of retaliation, Bertuzzi grabbed Moore from behind, punched him in the head, and then drove his head into the ice. Moore sustained head injuries, three fractured vertebrae, and has been unable to play for the Colorado Avalanche for over a year.

In his lawsuit, Moore is seeking unspecified damages from not only Bertuzzi, but also the partnership that owns the Canucks, the former general manager, coach Marc Crawford, and former player Brad May. The following defendants are accused of civil conspiracy, assault, battery, and negligence in the lawsuit.

Attorneys for the Canucks are presently attempting to get the lawsuit dismissed on the grounds that Moore was not a resident of Colorado at the time of the assault and therefore cannot legally file the lawsuit against the defendants. Moore's attorney argues that Moore lived in Denver for months after his attack, maintains a Denver mailing address where important bills are sent, holds Colorado registration and insurance, and intends to return to Colorado upon receiving medical clearance to play.
