Angel Leon sued KFM Joint Venture, its subsidiaries and some of his supervisors seeking economic, general and punitive damages. The suit alleges that KFM and its welding supervisors fired Leon because he questioned the firm's health and safety record.

The suit claims that Leon was questioned by KFM about cooperating with Cal-OSHA regulators in May 2004.

Cal-OSHA later reported that KFM had knowingly overexposed welders to toxic manganese fumes. According to the lawsuit, Leon was retaliated against for demanding medical tests, and he was demoted around that time.
