The claim alleges negligence for the delayed response to Brady's brain injury and is portioning $500,000 of the requested award to be used to pay for Brady's medical expenses. The night of Brady's critical injury there was no standby ambulance as there had been at games in the past. Standby ambulances had always been present at games until 2003 until they were dropped due to cost. According to doctors, when the brain is injured, an immediate emergency medical response is necessary to avoid further injury and increased recovery time. Due to this fact, the Berans believe that if a standby ambulance had been present at the game, Brady may not have had such a difficult time recovering. Since Brady's brain injury, standby ambulances have been present at every football game.
If there is no response to the claim by the Lincoln School Board and the Lincoln City Council with in the next six months, the Berans will be able to file a civil lawsuit.
