The incident occurred while Diane Morrow was in front of Calumet Harley-Davidson. Jovan's, a private landscaping company, was mowing the lawn outside of the dealership when the object was launched from lawnmower and struck Morrow in the head.

The Town of Munster has repeatedly denied any responsibility in the incident. Munster is included within a list of 11 other defendants who will be compensating Morrow for her injuries.
