Officials Expect New Home Development Project to Trigger Lawsuits

Harbor Bay Isle Associates is preparing to build 100 homes along the Harbor Bay Parkway, an area previously banned from housing development. The area was to be used to build office space for the Harbor Bay Business Park, but a slow market quickly changed these plans.

Port officials had proposed that the homes be built with new sound insulation technology and that an agreement be made stating that the homeowners association would not sue the port. However, the committee rejected this proposal, referring to an Alameda case filed several years ago where residents formed a separate homeowners association in order to file complaints.

The Port of Oakland's aviation committee will continue to discuss the issue and is also attempting to convince the developers to post a $1 million bond to be used to fight future noise complaints.
