David Dwight Smith, 46, was convicted of murder and gun possession in the fatal shooting of 32-year-old Robert Finley.

The shooting occurred in January of 1997 because Finley owed Smith money from a previous drug deal.

Smith was tried in 1997 and received a sentence of life in prison. However, the ruling was overturned on grounds that he did not have effective legal guidance.

Smith must serve all 35 years of his prison sentence and is not eligible for parole.
