In 2002, Nolte was pulled over for driving erratically down Pacific Coast Highway and did not pass a field sobriety test. He was accused of driving under the influence of Gamma-hydroxybutyrate, more commonly known as GHB or the "date-rape" drug.

According to Nolte's lawyer, the 64-year-old actor unintentionally consumed GHB in a weightlifting supplement.

Three days after his arrest Nolte voluntarily entered a substance abuse rehabilitation center, where he stayed for several weeks.

In December 2002, Nolte was ordered to serve three years probation with counseling and drug testing and has recently been released.
