NY Smokers Sue Phillip Morris for Lung Cancer Screenings

The lawsuit was filed in federal court, on behalf of Marlboro smokers age 50 or older who smoked at least a pack of cigarettes a day for 20 years.

The plaintiffs are demanding that the company pay for an annual low-dose CT scan of the chest. They are not asking for any compensatory or punitive damages.

An attorney representing the plaintiffs estimated the class size in the "tens of thousands." He said that the annual low-dose CT scans cost about $500 each.
