Medical Malpractice Victim Awarded $8 Million

The plaintiff, Jessica Greenfield, received more than $8 million for medical expenses, lost wages, and pain and suffering after a botched surgery permanently damaged her stomach and intestines and left her on a feeding tube, which she has used since 2000.

In her lawsuit, Greenfield alleged negligence after the surgeon who was attempting to correct her acid reflux severed nerves that were vital to the function of her stomach and intestines. The jury agreed, awarding her more than $4 million in economic damages and another $4 million for pain and suffering and loss of consortium.

Had the verdict been handed down prior to July, the noneconomic damages would have been limited to $445,000 in accordance with caps imposed by state law. In response to the verdict, representatives of the Wisconsin Hospital Association have urged lawmakers to reinstate new limits.
