James Denham was being taken into custody last December when the arresting officer accidentally shot him in the back. Just prior to the arrest, Denham had led officers on a lengthy car chase.

The wrongful death suit, which was filed on behalf of the victim's 12-year-old daughter, claims that Sgt. William Reed failed to keep his gun safe. The suit also alleges that the city failed to adequately train its officers on appropriate apprehension procedures.

The city's law director stated that the suit had not been reviewed yet and declined further comment on the case. Reed has been assigned to desk duty as an investigation into the shooting is completed.
