The lawsuit involving Palestine, Texas resident Beverly "Kim" Tilmon and the pharmaceutical company Wyeth ended in a mistrial on the second day of proceedings, the day after opening arguments.

Tilmon's attorneys moved for a mistrial because of comments made by Wyeth's attorneys. According to Jim Hankins, Tilmon's lawyer, the attorneys for Wyeth "made, we think, inflammatory, misleading comments about the evidence."

According to an Anderson County court coordinator, jury selection for the case will begin on June 6.
