Mother Sues Property Owner Over Son's Death

Dominic DePaul was playing with a group of friends at the home, which his family rented, when a 13-square-foot slab came loose from a pile of rock and construction debris. DePaul was crushed and died instantly.

The lawsuit, which was filed in Lorain County Common Pleas Court, is asking for more than $1 million in punitive damages from the owner of the property, Allen Gasper, and five other unidentified defendants.

The pile of rocks was intended to prevent erosion at the lakefront home. The lawsuit claims that the boy's mother repeatedly complained about the unstable debris to Gasper.

Gasper declined to comment on the lawsuit, calling DePaul's death a tragic accident.
