The suit names an Arizona State University football player, the University's atheletic director and the football coach as defendants.
Brandon Falkner, 25, was killed March 26, 2005, outside a Scottsdale nightclub. Fellow ASU football player Loren Wade, 22, shot Falkner over a dispute involving Wade's girlfriend.
ASU officials admitted that Wade had a history of violence. Five separate complaints had been filed with the university and Scottsdale police in the weeks prior to the shooting. The school also acknowledged other problems with Wade's behavior, but did not release details.
An internal investigation conducted by the school revealed that athletic officials failed to notify other university administrators, finding that the school lacked a system for dealing with such situations.
In court papers, Falkner's father states that the school negligently failed to control Wade, claiming that it had a duty to protect the public from Wade's known violent predisposition.
School officials declined to comment on the lawsuit.
