Claussen, an Emeryville, Calif., lawyer who has been separated from his wife of eight years since May, cited California civil code, section 51 when he filed his civil rights suit last week in Alameda County Superior Court. He alleges Pasadena-based eHarmony is discriminating against him on the basis of his marital status.
In response to the lawsuit, eHarmony explains that it is in the business of matching singles who are "free of relationship commitments," and that customer surveys and focus groups have shown that the majority of its potential clients want partners who are divorced, widowed or never married.
