The old ruling was set in place by an Alexandria, Va., court in 2002. Hedberg was then awarded custody of his son, contingent upon his partner, Blaise Delahoussaye, moving out of the household. As a result, the two men sold their house, relocated to Maryland, a state that is considered friendlier to same-sex couples, and moved into separate apartments.
The new ruling came after Hedberg presented evidence to show that the court-imposed living arrangement harmed his son (who is now 13), turning a two-parent home into a one-parent home, and forcing them to live in an apartment because they could not afford a house.
