According to the lawsuit, stuntman Steven Scott Wheatly claims that during filming of a stunt scene, the pyrotechnics malfunctioned causing a gasoline explosion that engulfed him in flames. The stunt, which was to simulate a fiery missile attack on a Chevy Suburban, prematurely detonated while Wheatly was standing nearby.

Wheatly's lawsuit against Tom Cruise's production company and Paramount, which he filed in Los Angeles Superior Court, alleges negligence on the part of both parties and is requesting compensation for damages, as well as loss of marital relations.
