Woman awarded $5.6 million in bad faith case

Dimple Thomas, the plaintiff in the bad faith suit, was involved in an auto accident with another vehicle in November 1992. A passenger in the other vehicle sued Thomas' insurance company, Atlanta Casualty Co., and received a $60,000 judgment. The insurance company refused to pay the judgment and then sued Thomas stating that the company did not have to pay Thomas' claim because the company was not informed of the auto accident.

In court, attorneys for Thomas showed that Atlanta Casualty Co. had in fact signed a certified letter that gave the company notice of Thomas' auto accident.
