Office Max sued for defective chair

According to the lawsuit filed last week, a weld joint on the Zhejiang Himax Furniture chair failed, causing the seat to become detached from the cylinder. The lawsuit contends that the chair was poorly designed and constructed.

The accident occurred on May 5, 2004; six years after McQuillan purchased the chair from Office Max. McQuillan claims he suffered injuries to his legs, neck, and lower back. He is seeking more than $350,000 in damages for medical expenses and lost wages due to a resulting disability.

The lawsuit charges Office Max with breach of implied warranty, negligent misrepresentation, fraudulent misrepresentation, and negligence.

1/7/09 same thing happened to the same chair purchased in 3/20/07. they said they longer sold that chair (didnt say why) are refunding the vale. no major injuries but my 60 yr old mother banged the back of her head and her hip.

The same happened to my chair as well, the welding joint was ripped from the frame, and I fell backward. I spoke with the warranty company that Office Max refered me to and they told me sorry they can't help me because they don't offer replacement parts..... probably because they have been recalled as well.

I have a chair from Office Max that has done the same thing, I would have been injured too if my grand son had not been there to catch me. If my testomonial will help let me know. Zed

Please, let me know what I can do as the same thing happened to me this month with a Zhejiang Himax Computer chair and I fell out sideways. Luckily I was not injured but want a new chair and Office Max just refers me to their warranty service.

Chair I purchased from Office Max failed today (10-19-09) in the same manner as described above. SKU# 11491 96614. It was purchased about 2 years ago. The failure happened suddenly and I ended up on the floor. Luckily, I only bruised my wrist. I hope by now the defective chair is off the market.

I just had same thing happen at the office where I work. I was just pushing back to get out of the chair when I went over rather abruptly. Although I didn't hit my head, it was quite a shock to my back and I was tingling a bit throughout rest of the day. I was happy I wasn't lacerated on the stub of the center post. I thought this recall was recent, but apparently these chairs have been on the market quite a while. Office Max doesn't seem to be getting the word out on these.

Last night my chair broke too. I tipped over onto the floor and tried to catch myself and hurt my shoulder in the process. Haven't contacted Officemax yet but will do so today.

My chair could not be used well over 3 years. It was tilting dangerously and non-functional.
