Caruso and her husband were attending a concert at Staples High School. When they arrived, they were directed to park in the middle school parking lot, which was poorly illuminated, had not been cleared of ice and snow, and did not have adequate warning signs for the hazardous conditions. When Caruso stepped out of the car, she immediately slipped and fell.

As a result of the accident, Caruso has suffered several injuries to her ankle, lower leg, and wrist including an ankle sprain, wrist sprain, pain, numbness, inflammation, and bruising. She is expected to incur future medical expenses for treatment, hospitalization, tests, and medication as well as loss of wages from the time she has missed from work.

The defendants in the case include the Town of Westport, the Westport Board of Education, Superintendent of Schools Elliott Landon, Board of Education Chairman Mary Parmelee, and a custodial and maintenance company that has not been named. According to the lawsuit, Caruso's injuries were a direct result of the defendants' negligence and carelessness.

The amount of damages Caruso is seeking has not been released; however, according to court documents, the total exceeds $15,000.
