Plaintiffs Harry Corl, Cynthia L. Hodnett, Nyle Cearlock, Arlene Hancock, David L. Watts, and Donna S. Mobbs assert that Farmers charged them more for premiums based on credit history information contained in consumer reports without providing them adequate notice of the action.

In granting class action status to the suit on April 13, Judge Friot rejected Farmers' claim that its representatives had given the plaintiffs sufficient notice of the adverse action, saying that no evidence presented to the court showed proof of any such notice.

Judge Friot allowed for further change to the suit by stating it could be amended later if circumstances change.
