According to the lawsuit, in April 2002 Mark Day, of Terre Haute, went to HealthCheck Urgent Care Clinic for chest pain and difficulty breathing. He was released from the facility without undergoing any cardiac testing and experienced a massive heart attack the following day, the complaint states.

In July 2005, a panel of medical experts reviewed the matter and found the doctor who treated Day, Scott Ripple, guilty of negligence.

The lawsuit named Ripple, HealthCheck, and its operator, Midwest Medical Management, as defendants in the suit. All three were represented by attorney Michael Roth of Eichhorn and Eichhorn out of Carmel.

The malpractice trial, conducted in Vigo County Superior Court Division 2, lasted six days.
