Woman alleges Stand'n Seal caused husband's death

In the lawsuit, Patricia Kayser claims that her husband died from the effects of fumes he inhaled while using Stand'n Seal Grout Sealer. According to his family, Thomas Kayser used the product as directed in August 2005. A day after using Stand'n Seal, he was hospitalized for chemical burns in his lungs. About one month later, Kayser died. He was 65.

Patricia Kayser's lawsuit names Roanoke Companies Group and Tile Perfect for manufacturing a defective product. The lawsuit also charges Home Depot, the product's exclusive distributor, with negligence for selling the defective product. Each of the companies asked for a dismissal of the lawsuit. They claim Thomas Kayser was responsible for the injuries that caused his own death.

On August 31, 2005, the U.S. Consumer Product Safety Commission recalled a batch of Stand'n Seal Grout Sealer. The recall stated that 88 users reported adverse reactions from product use. By the time of the recall, Thomas Kayser had already used the product.

Patricia Kayser's lawsuit is seeking damages for medical expenses, funeral costs, loss of accumulation to Kayser's estate and spousal consortium.
