Donald L. Burdick filed the suit against Milwaukee’s Extendicare Homes. At the time Extendicare was operating Lakeside Nursing & Rehabilitation, a nursing home in Chippewa Falls.
In the lawsuit Burdick alleged that he received inadequate care during his stay at Lakeside following heart surgery in 2002. The suit stated that he sustained bedsores because staff members failed to take appropriate measures in his care. Burdick was transferred to another nursing home and multiple hospitals.
A spokesperson for Extendicare said that both Burdick and the company were pleased with the results of the settlement.
Eau Claire County Judge Lisa Stark ordered that $1.3 million of the settlement be earmarked for a special needs trust for Burdick. Approximately $900,000 will be applied toward legal expenses.
In the three years leading to May 31, Lakeside has been issued 76 citations for violating federal nursing home guidelines.
Last year Lakeside was purchased by Snowhill Health Care, which renamed the facility Wissota Health and Regional Vent Center.
