Three-Year Sentence Given in Fatal DUI Case

Joshua Livingston, 23, was driving at 108.5 mph on May 2, 2005, when he crashed his vehicle into a ditch and rolled several times. One passenger, 22-year-old James Alvarado, died at the scene. Livingston and another passenger were taken to the hospital and treated for their injuries.

Livingston pleaded guilty to charges of reckless homicide and driving intoxicated. According to reports, Livingston had a blood alcohol level of 0.24 percent, three times the legal limit, at the time of the crash.

The judge sentenced Livingston to three years for DUI and three years for reckless homicide, set to run concurrently. Livingston will receive credit for the 255 days he has already spent in jail since the accident.

Alvarado's family members sat in the court room on the day of Livingston's sentencing wearing T-shirts with pictures of Alvarado holding his newborn daughter, born a day before the accident. They find it unfair that she will grow up without a father and just hope that Livingston will learn from his sentence.
