The suit was filed by Carolyn Welch in Blount County Circuit Court. She is seeking $20 million dollars -- $10 million in compensatory damages and $10 million in punitive damages. She is also seeking to recover the legal costs incurred as part of the suit.
The suit alleges that ALCOA, an aluminum producer, was aware of reports that workers had contracted cancer from asbestos exposure, yet failed to warn Donald Welch of the existence and dangers of asbestos at their plant.
The suit claims that Welch developed esophageal cancer from exposure to asbestos-containing materials and dust during his time as a contractor at ALCOA's plant in Alcoa, Tennesee. Welch died last year from his condition.
Melissa Copelan, community relations manager for ALCOA'S Tennessee Operations, said it is too early to comment on the lawsuit. She said the company is currently reviewing the case and is in the process of determining the proper course of action.
