Alan Placzkiewicz, 59, is serving a 15-year sentence after pleading guilty to charges relating to the discovery of cocaine and methamphetamines in his home the night he was attacked. The stabbing and drug investigations occurred jointly, and under a plea agreement, the cases were joined.

If Placzkiewicz’s petition for a plea withdrawal is successful, his attorney could move to have charges dismissed or a retrial may be scheduled. Placzkiewicz says he would have denied all charges had he been informed about the police’s possible mishandling of the case, which resulted in the release of his attacker.

The Gallatin County Attorney’s Office has 20 days in which to respond to the petition.
