The truck driver in question, Brandon Paul Stimpson, is being charged by the state with vehicular homicide, a misdemeanor. Stimpson admits to falling asleep while driving his truck on the afternoon of July 21, two miles east of Hansen, Idaho. The driver awoke seconds before crashing into a propane tank that was attached to the tractor of Sigifredo Martinez Aguilera, and the truck then sped 185 miles down the road.
Aguilera was ejected from the 1965 Massey Ferguson tractor, and was already dead when Stimpson went to check on him. Aguilera, age 31, is survived by his wife, Sylvia Ramirez, and two children.
Ramirez has brought a civil suit against Stimpson and his employer, Ecowater, on the grounds that the company owned the truck in question and allowed Stimpson to operate the vehicle. She is being represented by the Hepworth, Lezamiz and Janis law firm, and is demanding money to cover funeral expenses, legal fees, and wrongful death damages.
Neither Stimpson nor Ecowater has responded to the complaint in the civil case.
