The 40-foot tour boat called the “Ethan Allen," owned by Shoreline Cruise Inc., overturned and sank on Oct. 2 last year. A representative from Shoreline says the Mohican, a steamboat owned by the Lake George Steamboat Company, left a wake as it sailed past the Ethan Allen, causing it to capsize.

The National Transportation Safety Board says passenger overload is also being considered as a possible cause of the accident.

Shoreline and the Lake George Steamboat Company were in court recently as Judge Thomas McEvoy denied the steamboat company’s motion to limit the amount of damages it could be held accountable for in the disaster.

The Ethan Allen could be inspected by lawyers and their experts within the next month.
