The recent settlement came more than two-and-a-half years after Mark Hamo died in the accident in Akron, Ohio.
According to court documents, on the afternoon of March 10, 2004, Hamo was driving north on Riverview Road when an out-of-control semi-truck turned onto his path. Hamo did not have time to get out of the vehicle's way and was crushed as the truck tipped over onto his Volkswagen Golf.
Cecil Hall, the truck's driver, told an officer that he realized the brakes on his truck went out shortly before the collision with Hamo's car.
Problems with the truck's brakes had led Hall to have the vehicle serviced a week before the accident. However, on the day of the crash, two motorists traveling behind him noticed smoke coming from the big rig's wheels and smelled rubber and brakes, the Hamo family's attorney said.
Johnny's Commercial Maintenance, the company that serviced the truck's brakes, agreed to pay $250,000 of the family's settlement.
Hamo, 27, lived in Cuyahoga Falls and worked as a marketing representative for an insurance firm. He is survived by his father, mother, and two brothers.
