Moreno was 23 and on her honeymoon the day she rode the attraction. According to her family's attorney, Barry Novack, Moreno reported feeling very odd immediately after getting off the ride, and she passed out after returning that day to the hotel where she was staying with her husband. She was then taken to the Cedars-Sinai Medical Center in Los Angeles. She never regained consciousness, and died approximately two months later.

The lawsuit alleged that Disneyland had not made the ride safe enough and did not adequately warn riders of the dangers, despite Disneyland's knowledge of previous injuries on the ride. Pretrial motions and jury selection scheduled to begin January 4, 2007 were cancelled due to the settlement, the details of which have not been disclosed. Two other brain-injury lawsuits were filed by Indiana Jones Adventure passengers or their families in the past; Barry Novack also handled those cases, which were also settled by Walt Disney Co.
