The cardiologists were ordered to pay back the money in response to a qui tam claim filed by two women who formerly worked as financial services representatives for the company. Kristi Moore and Valerie Byrd filed a complaint on behalf of the United States and the state of Tennessee after the company failed to remit overpayments to Medicare, Medicaid and TennCare, all federally funded programs.
Under the Federal False Claims Act, the women are entitled to a portion of the settlement. Each woman will receive $334,287 for filing the claims and for participating in the investigation.
ETHC must also pay the $167,449 to various insurance companies; $1,043,629 to 11,220 patients; $201,104 to the state of Tennessee; and $1,498,896 to the United States Government.
No criminal charges have been brought against the doctors, who all submitted to investigation and agreed to the terms of the settlement, which included professional supervision.
