Michigan Family Agrees to $775K Settlement in Toxic Mold Suit

Tom and Kimberly Szymczak moved into their new four-bedroom home in May 2003. Ten months later, they abandoned the property when toxic mold was discovered in the walls and floors. It was determined that the mold had been caused by rain water which seeped into the home through a faulty roof and gutters.

The couple and their two young children left the house and their personal belongings within days of the mold’s discovery after a mold remediation company identified several types of aspergillus, Stachybotrys, and chaetomium – three strains of mold known to cause serious health problems.

The lawsuit, which alleged that the developers had misrepresented the quality of the home, was settled for $775,000. The Szymczak’s purchased the house for $374,000.
