Katrina Insurance Lawsuit Withdrawn During Federal Court Trial

It was the first Katrina insurance lawsuit in Louisiana to go to trial in federal court.

Lawrence and Elizabeth Tomlinson dropped the suit after being accused of misrepresenting their insurance claims.

In the suit, the couple claimed that Allstate had underpaid their claims and acted in bad faith.

Allstate paid the Tomlinsons more than $150,000 in damages. From that total, $30,000 covered living expenses for the couple once they moved into office space which they owned.

The couple claimed Allstate underpaid them for the damage to their home which they said included holes in their roof, allowing rain to damage the interior of the home.

Allstate accuses the Tomlinsons in court documents of misrepresentation and disputes the extent of the damage. The illinois-based insurer accuses the couple of over billing for renovations done to the home.
