Estate of Kansas City Worker Files Asbestos Suit

The complaint states that Briggs was employed as a laborer at both Owens Corning and Jay Wolfe Pontiac in Kansas City, Kansas.

Briggs died of mesothelioma, an aggressive cancer affecting the lining of the lungs, in 2005. The disease’s only known cause is asbestos exposure. Briggs’ estate claims he was exposed to asbestos from the defendants' products, which included the harmful material despite the availability of reasonable alternatives, the suit claims.

It was also completely foreseeable and should have been anticipated, the complaint states, that people working with or around asbestos would inhale, ingest, or otherwise absorb the substance.

The complaint goes on to claim that the defendants did not provide adequate warnings regarding the dangers of asbestos contained in their products, failed to provide the necessary asbestos handling instruction, and failed to conduct tests on the safety of their products in order to determine the dangers faced by those who worked with the products.
