Bus Accident Victim Receives $3 Million Settlement for Alleged Brain Injury

Fortmuller’s lawsuit alleged that she suffered a mild traumatic closed-brain injury and lower back injuries in the collision. Although no radiological evidence of a brain injury was presented, Fortmuller’s attorney stated that brain injury symptoms may not show up on medical tests. He described her as having symptoms of fatigue as well as sleep and memory loss. The lawsuit originally sought $55.8 million in compensatory damages.

The $3 million settlement from the transit authority includes a guaranteed annuity, with lifetime cost-of-living increases. Fortmuller was a merchant seaman at the time of the accident at the Hampton Roads Bridge Tunnel.
