Snowmobile Manufacturer Sued After Accident Leaves Rider Paralyzed

Donald Novack filed the personal injury lawsuit last month in Wabasha District Court. The suit names Minnesota-based Arctic Cat Inc. as the defendant.
The suit alleges that Arctic Cat Inc. sold Novack a Model 440 Sno Pro snowmobile in 2002 that was designed specifically for racing, but did not disclose that defects affecting the steering rendered the vehicle “unreasonably dangerous for its intended uses.”
During a race on Feb. 8, 2003, Novack was thrown from the sled and was hit by one or more of the other racers. Novack claims that the steering defect caused the accident, which resulted in his paraplegia.
Additionally, the lawsuit cites a recall notice issued by Arctic Cat Inc. on Sept. 18, 2006, as identifying the same defect that Novack alleges was present in his snowmobile.
The suit charges Arctic Cat Inc. with strict product liability, breach of express warranty, breach of implied warranty of fitness for a particular purpose, and negligence.
