According to an eyewitness report, Jason Janega, 35, hit Tiffany Baier as she was walking south on the edge of Route 31 in the town of Geneva on July 2, 2003. The witness told police that Janega did not stop his car, offer assistance, or attempt to find help at the scene of the incident.

According to police, the death was accidental and no alcohol was involved. In January 2004, Janega pleaded guilty to leaving the scene of a fatal accident and was sentenced to three months in a work release program, four years probation, and 200 hours of community service.

The Baier family’s lawsuit claimed Janega was careless because he failed to watch for pedestrians. Janega and the Baier family agreed to a $265,000 settlement.
